We have a case where the two sides are so far apart they will never reach an agreement. In fact I believe one side are actually so irrational and driven by some inner hatred of the other they don't want an agreement. They just want to cause distress. Only a court ruling will end it. But we feel pressured into going through a pointless attempt at mediation. The mediator will charge £4000. We and the other sides solicitors will waste about another £1000 in preparation fees and maybe more attending. So the clients will waste a lot of money and months of time just so we can tick the mediation box and protect ourselves against criticism from a judge when we eventually do get to court.. Great system
But then, the civil court system is so inefficient and useless you have to be crazy to go anywhere near it in the first place
