"Court rules are a Roguish thing, for law wee have a measure know what to trust to. Procedural Rulings are according to the conscience of him that are deciding them, and as that is larger or narrower so are rulings in English adjectival law. Tis all one as if they should make the Standard for the measure we call A foot, to be the Judge's foot; what an uncertain measure this would be. One judge has a long foot, another short foot, a third an indifferent foot; this the same thing in the Court's Conscience".
