Jacjkson LJ did not dream up the new rules. The new rules were supported by the same groups who now complain. The LSEW in particular supported costs budgeting. Looking at Mitchell and Rattan v UBS (where the Claimant's solicitors were criticised by the Judge for introducing a futile point) it can be seen that a small minority of the profession have only themselves to blame. Some solicitors need to get a grip on modern day litigation! If its too hot in the kitchen you know what to do...
