I entirely accept everything that Ahmat Thomson says except his apparent conclusion that the Practice Note is a good thing overall. His very lengthy exposition of Islamic succession and indeed the apparent distinction between Shi'a and Sunni is clear evidence (if any was needed) that this is a (mine)field that no non-Islamic solicitor should venture near. I think we all know that continental jurisdictions especially those base on the Code Napoleon have distinctive testamentary characteristics compared with our own but as far as I am aware, there is no Practice Note dealing with those?
