The problem Jackson has created, or exacerbated, is one of simple economics. You can't run a fully compliant litigation practice properly, run your cases under the ever-changing CPR, provide minimum prof indemnity cover of £3m per file, the list is endless, without charging what it all costs, otherwise the business model is unsustainable. Add to that the non-recoverability of success fees and ATE premiums, fixed recoverable fees by costs budgeting, higher court fees, and you have exactly what the Government and senior judiciary intended, an insurmountable barrier to the vast majority of claimants. Then courts can be closed, court staff can be reduced, and the vulnerable and others deserving of civil justice are left without remedies. The senior judiciary are letting our society down, they should be our champions against injustice not colluding in current political objectives. As for the lawyers, some will soldier on out of public duty, others will just find something else to do. It is naive to think any of this is unintended.
