Well well...why are none of us surprised ? We all know the small value claims can involve complex areas of law..the whole idea that because a claim is below £10,000 there should be no costs recovery is ludicrous...basing costs recovery on monetary value is inherently flawed...you can see why they did it when the small claims limit was very low... there is some sort of sense of not having costs of £20,000 awarded when there is only £200 in dispute but seriously £10,000 ? That's a lot of money to most ordinary people...so now the DJ's have the horror of dealing with emotionally charged often quite mad LIP's ? Well in this age when solicitors are no more highly regarded than someone who does a job that involves say a one month induction perhaps gradually our value to the general public and the judiciary will once again have a modicum of value ? Then again maybe not.......
