It’s been long argued about how EL/PL claims would not be suitable for the Portal. Yet the defendants decided to force it in anyway. What they’ve been left with is a system that they are forced to use after being incomplete and rushed in. Of course they would have lots to moan about. It’s rubbish for these claims. They have no one to blame but themselves.

They will argue to the death that the CNF is incomplete and that they will have no choice but to drop the case out. But after filling this form in countless times, I’ve realised that it doesn’t seem to be any help to them at all. It’s them who have the issue with it. Not the claimants. In respect of the Noise Induced Hearing Loss Claims, there are constant arguments about considering the HMRC employment history schedule as a necessary document. They also demand that the Medical Records, or the Medical Report or even your blood is necessary to the claim. They threaten that without it they won’t even look at the claim and will be forced to drop it out. But if it was so important, why didn’t they put these requirements into the Pre-Action Portal for low value claims? They even had a bit of help from CPR rules which were brought in long ago and set out requirements for what is necessary documentation to exchange. They could have just copied it.

They put a timescale on the Portal that most times cannot be complied with. So how can they constantly whine about the lack of response if they can’t even read a calendar? What Claimant solicitors are forced to experience is an online version of a Letter of Claim that may not be looked at until the very last minute. They then have the cheek to ask for answers to about 100 questions which would have been answered if they had read the CNF properly. That’s when you realise, that the file handler on the other side probably doesn’t even know that case exists. They got a paralegal to sign off the pointless letter.

They can cry about it all they want. But if you’re given a nice big plate and asked to fill it with whatever you want. It would be ridiculous to complain that that you didn’t get your fill afterwards.
