Justices, Elias, Gloster and Laws almost certainly did not understand the disservice that they have rendered to consumers in their recent Jet2 decision. It now adds an unnecessary pressure on all aircraft commanders to operate aircraft with technical problems when the captain's experience dictates refusal. Some foreign airlines do not have the same safety standards as Jet2 and other airlines in the EU, yet they are free to carry EU passengers and have to apply Regulation 261/2004. The Justices' decision, probably made without any real understanding of its unintended impact, have done a massive disservice to air safety. Sooner or later an aircraft will be lost as a consequence of this folly. I intend to remind each of the Justices of the part that they played when this occurs.
