The most crucial point which is highlighted above albeit in a cursory manner is the turmoil which the court service is currently in. It is all very well for the focus to be on practitioners keeping to deadlines and being clear about costs incurred but when is anyone going to assist the courts with more resources. Surely a large part of Mitchell was aimed at getting things to run more smoothly but everyone seems to forget that the service needs the resources to deal with the rule changes. Whilst practitioners are forced into the Mitchell straight jacket the court service don't have the resources to process paperwork efficiently, answer any correspondence or calls or indeed deal with the large volume of work undoubtedly increased by Mitchell and the satellite litigation arising from it. When will attentions be turned to this very real crisis which is going on on a daily basis?
