Why should there be a cap on loss of future earnings to a multiplier of the average salary, are we to jetison the very foundation of the law of neglignece as a result of a 'blip' ?(Grayling, yes you boy, put your hand down, this is what's known as a rhetorical question)

If claims do not have prospects then the insurer will not pay either damages or costs. Claimant firms who present cases with poor prospects will lose money and either stop doing the work or go bust.

If the government had wanted to control the 'comnpensation culture' they wouldn't have introduced QWOCS which is probably the biggest incentive to bring unmerited claims.
