With all due respect costs and damages are not paid in all cases, in fact a small proportion of cases c.3% if memory serves are settled or succeed at trial.

Of course claims with no merits need to be defended and this does cost money, but not on the scale suggested by the MDU which is c.40% of the cost of the NHS 'if inflation continues at the current pace' which is I would suggest a fatuous statement as inflation rates would if stable eventually result in more negligence claims then there were health care events.

Will new entrants be competent, inevitably many of them will not, after all there are plenty of claimant firms doing low value RTC work who can't master that (i.e. I saw a case today where the medical report said 4 weeks of work, the CRU was a few £k and yet no LOE claimed?

The NHSLA and MDU etc are well known for defending th indefensible for years and then moaning about costs.

Perhaps they should look at their actions and those that they instruct?

Perhpas also if the NHS had a culture of dealing with dysfunctional doctors and looking to manage and prevent risk? Reading Private Eye it is barely an issue goes bye without another report of a cover up and serial c*ck up.
