Could Mitchell's solicitors, Atkins Thomson, appeal out of time for the decision in that case to be reversed? It seems to me that to be six days late in complying with an order is very harsh, especially when the costs estimate was in before the next hearing and no one was disadvantaged.

What a dreadful mess that decision has made! The judges involved at first instance and on appeal should be sacked for incompetence and spinelessness respectively. But they won't be, they will be promoted and retire on nice pensions those in private practice can only dream of, especially those who took out Equitable Life pension policies.
