What a breath of fresh judicial air. Having been involved in High Court action (as one of some 14 parties) where the judicial outcome of the claim would have struggled to equal all the parties costs this news can only be good. Our claim settled when all parties eventually 'got it' and realised the outcome was not based on justice principle but money/commercial common sense. (It was a $4.6 million building dispute.) The Australians addressed this issue in 2005 with their Civil Procedure Act. Hopefully a similar reform will occur in England.
