David, they already can. But, and it's a big but, in fact sensitive and very disputed cases doing so is very difficult if an appeal based on alleged bias or refusal to hear the evidence in full is to be avoided. And deciding whose evidence is to be preferred takes time.

Anon. Not sure about your point. The LJJ would have been hearing other appeals if they hadn't been stuck with this one. If the parties could blow £500k on a £3500 value case then they're not short of a bob. On the other hand, the trial judge (10 days) and CA (3days) could almost certainly have been hearing something more important - children cases for example.
