Two steps, both within the control of the judges and the rules committees, can and should be taken: party-and-party costs should be fixed at the outset and expert evidence should be limited to a single, jointly-appointed expert. It is hypocritical of the senior judges to allow neither of these steps to be taken and to criticise litigants for incurring the costs which inevitably result.
