Having been in similar, albeit vastly less costly, litigation over in one case barely more area than a King-sized bedsheet, it isn't quite as simple as forcing the parties to see "sense" according to the trial or appellate judges. It isn't the Judges' land, it isn't their money or time, and it is all about resolving a "dispute" between two people who do care that the result is correct.
Perhaps, a small smidgen of acceptance that the Judiciary are, actually, a "service industry" and a bit of respect from them for the people who, ultimately, pay their salaries and pensions...the litigants who are taxpayers. Not "What are you wasting my time in my Court for?" I don't think the original "Pied Poudre" forerunners to our present judiciary had the temerity to call their customers unpleasant names because they had a dispute to resolve.
