What an utter, disgraceful waste of time and money.

In his Final Report, Jackson LJ said (at page 317) that £100,000 should be enough to cover the pursuit of the vast majority of private nuisance claims. We can safely say that that was something of an optimistic view, which illustrates why it may be unwise to allow judges to make up the rules on costs.
