Phillip Ambrose that's very interesting as I am acting for clients who are about to sue their former solicitors in this town for professional negligence (service of writ on defendant direct when their solicitors had said they were instructed to accept service) and on final day of the permissible four months). So if I include a request for, say, a declaration that they were in breach of contract and negligent would that take the claim outside the new fee regime please? I know this used to work under the (now former) rules for transfer of a simple debt claim to debtor's home court.
