I advised a charity which was tenant in common with a person whose affairs were being conducted in the CoP and was not directly involved in those proceedings. It was obvious from orders that the CoP had made neither its officials responsible for the case nor the solicitors representing the co-owner knew anything about trust and property law. Happily the other solicitors' legal executive, who was their specialist in CoP work, was willing to be guided and so, without continued delay, the transaction involving my client and theirs was completed under established trust law principles and ignoring the CoP's misguided attempts to interfere.

Should this this not re-open an earlier debate here about dumbing-down law practice and educating lawyers?
