Will we not see fixed costs in the multi track up to say £500 k value cases - a modest percentage of the value a bit like the old RTA regime. Would put an end to smaller value claims in the multi track so reducing the number of litigated cases and much costs budgeting hearings. Doesnt that sync with the thinking on proportionality? Not suggesting that would be right but must be attractive to people who think like Jackson and Dyson. By the way does anyone who actually does the job think that costs have gone up with budgeting - that has been my experience.
