Where the measure of a lawyer's worth is the number of billable hours the lawyer can record, those lawyers unable (for whatever reason) to record lots of billable hours will be passed over. Childcare is one factor which can limit the ability to work the billable hours expected or required, and, somewhat surprisingly in 2015, women are still mostly responsible for childcare. So the root cause of the problem is (as with almost everything else in law) the tyranny of the billable hour.
