I had always understood that you could not claim for solicitors preparing bundles anyway, you can only claim at minor minion rate (under £100 in the provinces) and then the Court takes a totally uninformed view of how long it takes to prepare (particularly a complex case) bundle. Actually arent appeal bundles usually considerably less than the original (and/or if the Bundles have already been prepared for a Trial it shouldnt take long or be difficult to extend that by a smaller additional Appeal Bundle). I do find it bizarre that there was no pagination in the Index, that seems to be a most basic principle of a Bundle? After 25 years in practice and a few tellings off I always check the Rules now before preparing a Bundle in case something has changed since the last time. But surely the answer here was. when the Bundle was received, for the Court staff to notice that the pagination was missing or whatever and send it back to the solicitors for correction? We have had this with a Bundle at the local Court before (returned referring us to the CPR) although perhaps that was after judicial comment in advance of the Hearing
