Let's look at what the stats say and mean. One, the largest mediation provider says that they are getting 40000 enquiries p.a. If they represent half of all mediation enquiries, that makes 80000, yes? But only 8000 mediations started, against 34000 court starts over the same period. What that means is that the obligatory referral to a mediator before court proceedings start results in only 10% of cases converting to mediations, 42.5% going on to court, the rest, who knows. 90% don't go on to mediation, the real issue is why and do the rest give up? What it doesn't mean is that the governments policy of diverting people to mediation is actually beginning to work.
