Costs are NOT disproportionate as far as the victim is concerned. They have suffered injury as a result of negligence and are entitled to compensation. The fact that the cost of satisfying their claim is higher than the damages is not the fault of the victim. There is a further danger here that claimants with damages amounting to less than £10k will not be able to claim as the cost of claiming would be too high - much the same has already occurred for non-PI claims where there is an adverse costs risk so the combination of required ATE and the solicitors success fee means that clients who were previously able to "access justice" are now barred from doing so because of the costs. Rather than finding ways of making it impossible to make genuine reasonable claims the government should be concentrating on re-establishing the regime of "access to justice" that made our legal system the envy of the world, rather than destroying it in a witch hunt for the small minority that abused the system.
