By all means fix fees, but set them at the right limit - and build in immediate sanctions when (not if) there's mucking about by the Defendant's insurer or solicitor.

As mentioned elsewhere - the level of damages is the wring benchmark to apply when considering costs. It's very often the smaller actions that are more difficult on causation than the larger matters.

If Claimant lawyers are to receive less, then build in a system that punishes Defendants for wasting time, and delays, and reward each party with sensible levels of costs for early resolution.

Sadly, the voice of reason and common sense never seems to prevail though, does it?
