Mr Densley says that because patients have suffered injury as a result of negligence they are entitled to compensation. As a matter of present law that is correct but it does not follow that this is the only way of ordering society. Given the astronomic legal costs of medical negligence cases it might be reasonable for the government to legislate to say that patients should be bear the risk of medical negligence where the loss is less than say £10,000
