Unless things have changed recently, the NHS are self-insurers. They (the Government) have always refused to basically lose control of the oversight and control of negligence in the NHS to the private Insurance industry. It would be far cheaper, cleaner, and might really make the NHS stop cutting the wrong limbs off, leaving half the cutlery drawer and swabs in patients, and generally buggering up routine surgery. If they had to answer and pay a market premium!
The Government wants to defeat The Access the Justice Act 1999 and the fundamentals of the exchange for the withdrawal of civil Legal Aid, then it should put the matter out to private tender.
It won't.
