Insurers know they can't change (or will find it very hard to) the substantive law of negligence and they can't rewind time to the 90's when most people didn't know they could claim so their only option is to block access to justice by making the process unprofitable for firms or too expensive for clients. As it is their only route they will continue; expect reduced fixed fees and other measures in the years to come. The question will be whether the public wants to value access to justice above the possibility of reduced premiums - unless the insurers pass on those savings pretty quickly they'll find it difficult to keep the momentum up.
