A "simple" RTA can take the standard protocol period (3 months + 21 days) for a denial of liability response. Then getting medical records adds on at least 7 weeks or more if payment is requested before notes are released. Allow 3 months to get medical evidence and investigate specials, then 5 weeks to get instructions, make a Part 36 and wait for the offer to expire.

Issue and wait for 3 weeks for the claim to be issued. Then get directions questionnaires. Wait around 6 weeks since issuing for the claim to be transferred from the CCMCC. Wait 2 to 4 weeks for the new court to issue directions. Then add 6 months on for everything to come to trial.

That's a simple matter, taking around 18 months with no allowance for additional time wasting by any party or the court. You can add on a couple of weeks for bits and pieces such as getting written authority to submit a claim and so on.

The only way to make these cases pay is for them to get to trial so you get £2,655 + 20% damages as your costs.

On balance it is a good thing you stopped doing it a while ago!
