There was never any proper justification for allowing success fees to remain in insolvency cases. The principle should apply equally over all types of cases. The suggestion that success fees were allowed as a rod to beat rogue directors with is risible. Success fees were allowed to remain because HMRC is the biggest litigator in the land and the decision was borne out of political expediency and nothing else. Unfortunately much of what Jackson intended was hijacked by the politicians to the overall detriment of the reforms.
