The point about this case is that it highlights the difficulties family lawyers are placed in particularly with the demise of legal aid in any matter other than domestic abuse and public law. It must be right that in cases of limited means a solicitor is able to limit the retainer and the duty to investigate is limited to what is reasonable. In this case it is clear that Mrs Minkin had sought previous legal advice, the question is, was that advice unpalatable such that she sought to go behind that advice and do her own thing anyway? Clearly Mrs Minkin feels agreived at the outcome, it was not the outcome that she wanted. She had the benefit of solicitors and counsel, is she now going to sue them because they didn't achieve what she wanted?
