How about defendant insurers start litigating sensibly and thereby save a fortune? They almost never put forward offers at Stage 2 which are anywhere near a reasonable sum which means they have to go to stage 3, fail to beat their ridiculous offers and pay the stage 3 costs of £500 plus VAT on the lowest value cases.
At the other end you still have insurers paying out on travel anxiety only cases when the law is so clear that you get naff all for that. Until the insurers defend claims sensibly they cannot blame claimants for the high costs.
