Anon 4.46, thank you, with your ad hominem attack you've kind of proved my point. Let me now attack yours on the basis of what you said rather then what I think you are. You say a potential award of costs against them is a deterrent. Is it really? The number of claims thrown out from LVIs, to downright staged accidents suggests otherwise. I have spoken to barristers utterly baffled as to why Cs have continued a claim. Of course you're also not taking account the fact that defendants are often caught between a rock and a hard place, do they defend claims when they know the judge might be ignore the evidence, or do they accep that paying the claim and a small amount of costs is the only economic thing to do, even if not the right thing? As I said, arrogant, lacking in humility, and I should also add incapable of taking any objective view on this subject.
