The challenging firms have only one purpose in incorporation which is to limit their liability for costs. The individual firms or even an incorporated association would have locus and it is to be hoped that Mr Justice Stuart-Smith sees through the firms attempts to evade exposure. We will see how keen the firms are on their individual cases if they have to fund both the costs of the application and the MOJ's costs if they lose.
