What are the nastiest injuries that could be sustained at around the £5000 general damages limit within the overall £10,000 limit for the small claims track? I seem to recall they can be quite unpleasant and debilitating.

This is what needs highlighting in efforts to fight the change rather than minor whiplash injuries.

The average factory worker who has just had his finger tip lopped off due to inadequate safety procedures at work has little chance of proving liability so won't get over that hurdle. Even claims with a month off work unpaid will be unlikely to get over the £10K hurdle required to get recoverable representation.

If minor whiplash claims are being banned (most of which extremely minor but exaggerated or non existent injuries) why is there any need to change the small claims limit and hump people with serious injuries valued at up to £5000 generals.

Being out of work and not getting paid coupled with a nasty injury with no realistic prospect of compensation seems fairly outrageous.

Anyone involved in the industry knows insurers will simply deny everything and hope most genuine claimants are too bamboozled by court procedure their claim will fail.
