This reads suspiciously like the old Hart Devlin overlap. On the one hand the decisions of officials are there to sanctify the assumed law, which is law because the officials promulgate it, on the other hand the law only changes even to decriminality, (like canabis smoking), when enough of a populous act in a contrary way to the previously perceived norm that again was always the norm because of application by officials. In the meantime, and in the transitional period, the penalty gets more draconian in a way as more officials are employed to apply laws that are being more discredited .....
