Since time immemorial, sinecured buffoons like Briggs have assumed that if there is a dispute, it has to go to court. And so ignored the fact that the vast majority of cases are settled without proceedings being issued, when in reality the rules of such proceedings dictate the negotiation of all the pre-litigation claims. The vast majority of claimants in all sub-£25k claims will want to engage a lawyer. Clearly if the new court is lawyer-free then there will be absolutely no provision for pre-action lawyers' costs. Want a lawyer? You pay! Win or lose! Liability insurers must think they are in some neverending wet dream. They, of course will have armies of expert lawyers to deal with claimants in person at all stages, and ironically all paid for by premium payers, whatever it costs, and built-in to next year's rates. in full. 100%. No issues of disproportionality for them - you can't get detailed assessment of your insurance premium.
