I'm not sure of - actually I don't know - the mechanics of the problem.

But, my impression is that the form as presented netted out debts without showing them. If so the other side and the court would most likely be unaware of the error. I say this because a press report said that the person who reported it had a client who couldn't get the web site to do a calculation net of debt.

My, now hazy, memory of Form E is that it showed the value of the matrimonial home net of mortgage and without showing the mortgage debt. Useful of there was to be a transfer subject to mortgage - not! But consistent with what I say above.

I suspect that most of those affected will have been unrepresented, which may explain the time delay before the error was spotted and why solicitors did not spot it.
