The problem here is that the MOJ are carrying out an impact assessment. The MOJ are so partisan, and have shown themselves to be so poorly biased against access to justice (the increase in court fees, and closure of courts to name but two recent examples) that any study wouldn't really be worth the paper it's written on.

Let's first see why there needs to be an increase. One exanple is RPI. RPI from the last increase to date would see a level at less than £2,000. RPI hasn't however really ever been properly attracted to damages, so the comparison there is a poor one - levels of GDs are woefully low. So, any increase should be modest, with a proper addition to GDs - sauce for the goose and all that.

Next - who doe this benefit? The insurer.

Who or what does it does it disbenefit? The Public, the Treasury (ironically), Taxation (massive loss of industry), CRU, Health and Safety... this isn't an exhaustive list.

Any impact study needs to be carried out by an independently commissioned economist who is FULLY briefed - not given some cock and bull figures by the insurance industry.

Next - we're told that the motorist will benefit. Really? Since LASPO costs have fallen through the floor - and my RTA insurer wanted double the premium. No passing on of an estimaed £6.7 billion. So why should everyone lose massively, but insurers benefit even more? Why are the government bothered? In fact, why aren't the government massively concerned about the gigantic unintended consequences?

All of this stuff has been predicated on the back of Fraud. That's turned out to be a very large damp squib. The changes in process have barely had the ink dry on MedCo, ASKCUEPi or any of the other hairbrained schemes - and the figures of fraud have been embarssingly low for the ABI.

This, frankly stinks. There needs to be a completely incependent report sourced by anyone other than the insurance industry or the MOJ to look at the unbelievable wranglings that have happened - all to disbenefit the public.

I'm pleased to see that there is a Strategic Alliance ready to stand up to this nonsense, and I don't think I'm going to be too surprised at the results. When FOIL express concern as they have, you know something has to be seriously wrong.
