I should perhaps add, for the sake of clarity, that I consider English law to be of paramount importance to the commercial future of this country, as an internationally recognised reliable and fair code. 40 years ago English law was reputedly applied in 60% of international contracts; the last I heard it was 40%. There are plenty of other jurisdictions and systems which want a piece of this action. The various justice reforms play into their hands, by stifling the continuous development of English common law by the emphasis on ADR, and inhibiting worthwhile cases. Imagine if Salomon v. Salomon had been resolved at a mediation ....
