I was advised by John Scott of Ellesmere, a very good, practical lawyer, to get as much of my evidence sorted out before even telling the other side that a claim was contemplated. The appearance of being on the ball and ahead of the game is a useful tool. Some practitioners do everything in a piecemeal basis and at the last minute and so you know they are poorly prepared and probably don't or even won't go to a trial. A surprising amount of litigation is psychology.
