The problem as you point out above (3:11) is that there is a blindingly obvious lacuna in the rules. This does not need an appeal to resolve the issue, it needs a proper re-write to make provision for what happens when a matter is listed for disposal. In fact Judicial intervention can't solve this as either potential binary answer to the question would still leave a fundamentally broken system.
