Further to my post at 4.35pm today,and whilst I take on board David's comments, it seems that Leigh Day strongly deny the allegations brought against them in the SDT and perhaps it would be fairer to await the SDT's decision before condemning them. Whether or not LD were at fault in this particular case is not really the point, however. What concerns me is the government's threat to take "... measures to close down this shameless and shoddy racket’, by which it seems (from the implied assumption that any legal action against members of the armed forces under human rights laws is such a "racket") that all such causes of action will be barred. The government has form - they have also already threatened to abolish the cause of action where a soft tissue injury is worth under £5,000. What those measures will consist of is anyone's guess, but a blanket immunity, together with some form of legal sanctions against any firm unwise enough to accept instructions without somehow first obtaining a guarantee of success can't be ruled out.
