Thanks for that, Anon 9.36 and I see your point. I was just adopting what we diode in a similar case where the deceased left his entire estate to his four children of his first marriage. He was widowed and then remarried a wealthy woman who was not in need. However, she made a 1975 Act claim. The case was compromised by the executors and all interested parties agreeing a court order transferring the whole estate to the widow and she three months later made a gift to her step-children of 3/4 of the estate.

I appreciate that a charity has a duty to get in all it is entitled to, but the way this case has gone it looks as if no one will get anything. A compromise such as I have proposed, if legal and decent, would at least have avoided that outcome.
