What business is it of a judge to decide that what s/he THINKS is the 'morally correct thing' is what is to be imposed on one side or the other? Surely s/he is there to do justice, even if it doesn't fit her/his view of morality. Justice is a social construct and judges are too full of their own opinion of what it is or should be in each case (which in any case they make suspicious by equating it with Law). Morality is also a social construct, which is rarely rational; are judges now also allowed to impose their particular morality? Does any of this come into university or professional courses in Law?
