Lord Mckie made it clear that there never was a "compensation culture", only a blip in the number of claims due to the Miners' COPD and VWF scheme and, later the CMC.
The real problem was the use of under-qualified fee earners, working under fee targets and settling everything, occasionally without due regard to the risk of under-compensation. If I recall, Raley's demise was set in motion when a VWF claim settled without provision for the claimant's future need for gardening assistance at a cost. There are thousands of settlements that, like those that did for Raley's, just waiting to go bad. What price PII ?
