David Crawford hit the point as usual. The old system worked much as the parties wanted. Introducing a "system driven" approach has done nothing to reduce the cost of litigation and has produced some monstrous injustices for failing to tick boxes.

Litigation cannot be perfect because it involves people at their worst. Accept that you make the best of what you have and trust the parties to get on with it without nanny reckoning that that she knows best.
