Actually, the situation might well not be different if a surveyor or solicitor failed to find or notify a client that the property was affected by subsidence. If the subsidence had stopped by the time of trial, there might be no (or less) loss: see McKinnon v Esurv [2003] EWHC 475 (Ch).
