Anon 07.29 am for my part I can assure you that in my general litigation experience (over 40 years) the lawyers who most often prevaricate and resist at every verse end have been acting for insurance companies. More than once I have been assured that such behaviour has the approval of the insurance client because it results in enough otherwise genuine claims being defeated or having their value diminished to produce an overall saving when compared with the increases in costs. Insurance is a numbers game so dishonestly defending a valid claim is seen as justified because, on average, that behaviour saves more than it costs.
Incidentally third party capture and offers before medical exam fall into the 'money game' bracket too. The insurers reckon that overall they save more money than they pay out, even though settlement before medical is fully acknowledged as encouraging fraud. Add the fact that insurers have been selling their own customers’ details to CMCs for years and the true repository of fraud can be identified.
As for your experience in a defendant fraud team, maybe your viewpoint is distorted by only seeing those cases, just as divorce lawyers often have a poor view of marriage.
