The whole point about the CLAC was that it was an experiment that the LSC was told by me and others would fail. Why? Because legal aid rates are too low. In a falling market that makes undertaking legal aid unprofitable. Also, the issue about the CLAC was there was no consideration of conflict of interest.
The only way to solve the access to justice dilemma is to remove the ridiculous tendering process completely and let law firms with SQM or Lexcel conduct any area of law under Advice and Representation Schemes and for the granting of legal aid to be given to HMCTS and for LAA to be shut down. In other words-get rid of all the crap. The whole commissioning of publicly funded legal services bollocks needs to be buried and a simple, flexible system created which allows people to access justice.
